Advertising Contract Terms and Conditions
for Monthly Payments
1. General:
1.1. Mooi Troues reserves the right to decline any advertisement request should the advertiser’s business, service or products not meet Mooi Troues’ minimum advertising standards.
1.2. The advertiser has a 7-day cooling-off period from the date this agreement is signed by the advertiser or their representative.
2. Contract Duration:
2.1. This contract activates on the subscription start date and will continue month-to-month subscription basis that automatically renews every month.
2.2 The subscription remains active until cancelled by the advertiser in accordance with the cancellation policy.
3. Advertiser Benefits – Tiered Activation:
3.1. The advertising benefits applicable to the advertiser’s selected subscription package are set out on the following webpage: https://mediakit.mooitroues.co.za/benefits
This webpage forms an integral part of this agreement and is binding on both parties. All benefits are active from the commencement date of the subscription, unless otherwise stated.
3.2. Mooi Troues reserves the right to update the benefits from time to time. Any material changes will be communicated to the advertiser in writing. The version of the benefits applicable at the time of contract signature shall apply for the duration of the subscription term, unless the advertiser agrees otherwise in writing.

3.4. Where tiered activation applies, the advertiser acknowledges and agrees that certain benefits will only become available after the completion of the required number of consecutive active subscription months, as defined on the benefits page.
3.5. Subscription months must be continuous and fully paid for tiered benefits to activate. Any cancellation, suspension, failed payment, or lapses in subscription shall reset the tiered activation period.
3.6. All benefits are subject to Mooi Troues’ fair-use policy, content guidelines, design specifications, timelines and availability as published on the benefits page.
4. Payment Policy:
4.1. Invoices for debit order payments will be sent to the advertiser on the nominated debit order date for record purposes.
4.2. The payment will be processed by a monthly debit order.
4.3. Debit Order Terms:
4.3.1. The advertiser must sign a debit order authority permitting Mooi Troues to deduct the monthly subscription fee.
4.3.2. Advertisers must notify Mooi Troues immediately of any bank detail changes and sign a new debit order authority.
4.3.3. If a debit order is returned unpaid:
4.3.3.1. A penalty fee of R50.00 per unpaid debit order will be charged and must be paid together with debit order amount that returned unpaid.
4.3.3.2. The advertiser will be notified via email and must settle the outstanding amount of the unpaid debit order within 48 hours via an online payment link.
4.3.3.3. If the outstanding amount of the unpaid debit order is not paid, the advertising subscription will be paused, and the advertisement will be temporarily suspended until payment is received.
4.3.3.4. If a second consecutive debit order returns unpaid or within a 12-month period, then the clauses below will take effect:
4.3.3.4.1. Clause 4.3.3.2 will remain in place.
4.3.3.4.2. The debit order authority will be cancelled by Mooi Troues.
4.3.3.4.3. The advertiser may continue their subscription by subscribing to into an annual prepaid advertising
subscription.
5. Rate Increases:
5.1. Mooi Troues reserves the right to increase the monthly advertising fee from time to time.
5.2. Rate increases will be communicated to the advertiser in writing via e-mail at least 30 (thirty) days prior to the effective date of the new rate.
5.3. The updated rate will automatically apply from the effective date specified in the notice, unless the advertiser cancels the subscription before the rate increase takes effect.
5. Cancellation Policy:
6.1. No cancellation fees apply due to the month-to-month nature of the subscription.
6.2. Cancellation Notification: The advertiser may cancel at any time by providing 30 days written notice to adverteer@mooitroues.co.za. Stopping your debit order does not cancel the subscription. Outstanding unpaid invoices and penalty fees remain payable.
6.3. Complaints about the advertiser: Mooi Troues may cancel a subscription if legitimate complaints are received about the advertiser’s products or services. The advertiser will be allowed to provide written feedback. If the investigation shows that the advertiser may harm the Mooi Troues brand or violates our policies, the advertisement will be removed immediately without refund.
6.4. Mutual Respect and Discrimination Policy: Mooi Troues does not tolerate discrimination or abusive behavior. Any violation may result in immediate cancellation of the advertiser’s subscription without refund.
7. Refunds Policy:
7.1. No refunds will be issued for subscriptions or bookings.
7.2. The only refunds allowed are in cases where Mooi Troues incorrectly deducts a debit order amount.
8. The advertiser’s advertisement on Mooi Troues:
8.1. Mooi Troues cannot guarantee specific results, leads, or statistics.
8.2. It is the advertiser’s responsibility to keep their advertisement up to date.
8.3. Mooi Troues offers one free English-to-Afrikaans translation during the initial setup of the advertisement. Additional translations are R500 for up to 300 words plus R2 per word above 300.
8.4. Editorial approvals are at the discretion of the editorial team and are not guaranteed.
9. Advertising Artwork Requirements:
9.1. Artwork includes, but is not limited to, all images, logos, write-ups, text, links, and other materials required for the advertisement.
9.2. The Advertiser must comply with Mooi Troues’ advertising specifications as emailed by our team.
9.3. The advertiser must supply all required artwork.
9.4. If the artwork does not meet specifications, Mooi Troues will request replacements.
9.5. Advertisements will go live on the advertisement subscription start date, if all artwork has been received from the advertiser within the set deadline for the artwork sent via e-mail.
9.6. If the advertiser misses the deadline, the advertisement will be online within five business days from the date all required artwork was received from the advertiser.
9.7. Credits for artworks used for advertisements:
9.7.1. It is the advertiser’s responsibility to request permission from the artist for the usage of the artwork sent to Mooi Troues.
9.7.2. The advertiser should provide a list of artists to credit at the bottom of the advertisement. Mooi Troues will credit artists collectively, not per artwork.
9.7.3. Mooi Troues cannot be held responsible for any claims, fees, charges, royalties, usage fees, and or legal fees for artwork supplied to Mooi Troues by the advertiser. The advertiser takes full responsibility for all claims resulting from the artwork.
10. Liability Limitation:
In the unlikely event of total technical failure, a pandemic, illness, disasters, natural disasters, unnatural disasters, service provider changes, service providers of Mooi Troues closing, changes to business structures or systems, computer virus infections, computer bugs, system bugs, tampering, unauthorized intervention, fraud, technical interruptions, or any other causes beyond the control of Mooi Troues that may result in data loss or interruption of normal operations, neither party shall be liable for any indirect or consequential losses.
11. Domicilium Citandi et Executandi:
11.1. The Parties choose e-mail as the primary method for receiving all notices, communication, and correspondence relating to this agreement.
11.2. The Advertiser must provide a Physical Address for Debit Order and Billing Purposes, as required under South African banking regulations. This address is used for debit order verification, billing records, and financial administration on.
11.3. The Advertiser may, at their discretion, nominate the same physical address or another address as their Service Address to receive any physical notices relating to this agreement. If no Service Address is provided, all notices sent via email to the Advertiser’s nominated email address will be regarded as legally received.
11.4. Either Party may change their nominated email address, Physical Address, or Service Address by giving written notice via email to the other Party. The change will take effect within 7 (seven) days after the notice is sent
11.5. Notices sent by e-mail will be deemed to be received on the date they are sent, unless the sender receives an automated delivery failure notification.
11.6. In the event of default, Mooi Troues may apply for judgment to recover outstanding amounts.
12. Supporting Documents Required:
The Advertiser must submit the following supporting documents together with the completed advertising agreement:
12.1. Company CIPC Registration Document (only if the business is formally registered with the Companies and Intellectual Property Commission). The advertiser consents to the processing, storage, and retention of personal information as required by law.
12.2. Banking Details Confirmation Letter issued by the Advertiser’s bank, required for verification and debit order processing.
13. Privacy Policy:
13.1. The advertiser acknowledges having read the Privacy Policy available on mooitroues.co.za
13.2. The advertiser consents to the processing, storage, and retention of personal information as required by law.
14. Breach of Contract:
14.1. If the advertiser breaches any condition of this agreement, Mooi Troues may cancel the contract immediately.
14.2. Furthermore, In the event of the advertiser breaching any condition contained in this contract, the advertiser agrees to pay all legal and collection costs if legal action is required.
